This study aims to analyze the legal provisions related to domestic violence based on Law Number 23 of 2004 concerning the Elimination of Domestic Violence (PKDRT), how to prove psychological violence as a crime of domestic violence, and what is the juridical analysis of criminal liability for husbands who commit psychological violence against his wife before divorce (Decision of Nabire District Court Number 50/Pid.Sus/2021/PN NAB).

Legal Provisions and Proof of Psychological Violence

This study uses a normative legal research approach by analyzing applicable legal norms. The data used is secondary data, which consists of primary, secondary, and tertiary legal materials. The results showed that the increasing number of cases of violence, especially domestic violence committed by the husband against the wife, was one of the considerations in the formation of Law Number 23 of 2004. Article 5 of the law firmly stated that "Everyone is prohibited from doing Domestic violence against people in the household, whether through physical violence, psychological violence, sexual violence, or neglect in the household."

The process of proving psychological violence in cases of domestic violence must use the right type of visum et repertum, namely the post mortem psychiatric. This is important considering that psychological violence is often not physically visible, so the evidence presented must be able to show the psychological impact experienced by the victim.
